Should Big East Follow California's "Fair Pay For Play"?

The California law only applies to schools in California. It is a state law. Until such time as NY passes a similar law, the BE has no legs to stand on regarding such actions.. Besides we have teams in several states, so unless the Feds pass Pay to Play legislation there will be no legal avenue for multistate leagues to pursue. Even the Pac-12 will have problems with the California law.

Federal and state laws have little to do with it. There's nothing illegal with paying a player for an endorsement. It's just against NCAA rules. This California law will put the NCAA to the test. Hopefully the Big East schools are prepared to go full bore with it if the NCAA allows the Cali schools to do it without consequence.

Then there was no need to create such a law, if your position is correct. However, the new California law allows college athletes to profit from their name, image and likeness. not paying players is now illegal in California and subject to fines and penalties.

I'm not sure that's what the California thing says. I thought it was just that college kids in California can now be paid for being featured in Dunkin Donuts commercials, and/or running basketball clinics (or teaching tennis or swimming), and/or get paid if EA Sports uses their likeness... and they won't lose their eligibility. The athletes (like the 13th kid on the UC Santa Barbara bench) don't *have* to get paid, right?

the state of California is not part of the NCAA. A state challenging a rule of the NCAA is different than a conference that is part of the NCAA challenging it. The BE needs to wait and see how this pans out. Now if the PAC12 or B1G had made this move it would be a different story

Correct. Payments only apply to use of an athlete's name, likeness, and image. So they're only talking about a small group of "star" type players, not all players.

Yup. Let the state of California fight the battle on behalf of their state schools in the PAC/MW/Big West. It'll honestly be a very interesting test case, and if California gets the NCAA to back down then the Big East schools should get on board immediately. I honestly have zero problem with, say, Myles Powell doing some commercials for a North Jersey car dealership and getting some cash and a loaner car for his troubles.

If it were just that, I don't think anyone would have any problem.

However, the resistance is due to the potential for significant abuses that more than likely would happen.
